Agreement
By using Ergod - the Discord bot, the Telegram bot, or the web dashboard - you agree to these Terms of Service. If you don't agree, please don't use it. Continued use of Ergod after any changes to these terms constitutes acceptance of the updated terms.
Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction, whichever is higher) to use Ergod. The service relies on Discord's existing user agreement and age gate; we do not collect age information directly. By using Ergod you represent that you meet these requirements and have the legal capacity to enter into this agreement.
If you are using Ergod on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
Service description
Ergod is an AI agent bot that operates within Discord. It can:
- Read and write files in your isolated workspace
- Execute code and commands within Docker containers
- Search the web and fetch information
- Manage persistent memory and session history
- Coordinate multi-agent tasks
All operations run inside isolated containers scoped to your user workspace.
User responsibilities
When using Ergod, you agree to:
- Not use the service for illegal activity. Don't use Ergod to generate, store, or distribute illegal content or to assist any unlawful purpose.
- Not attempt to break sandbox isolation. The containers are isolated for a reason. Don't try to escape, exploit, or circumvent container boundaries.
- Not abuse the service. No spam, no overload, no intentional disruption. Use the service in good faith.
- Respect other users. If you share a server with other Ergod users, don't interfere with their workspaces or sessions.
Code execution & responsibility
Ergod can execute code and commands within isolated Docker containers on your behalf. By instructing Ergod to execute code, run commands, or perform actions, you assume full responsibility for those instructions and their outcomes. Specifically:
- Code runs in sandboxed containers with limited access to the host system. However, you are the decision-maker - the AI acts on your instructions.
- You are responsible for reviewing, understanding, and validating any AI-generated code, commands, or outputs before using them in production, deploying them outside the sandbox, or relying on them for any purpose.
- We are not liable for any consequences arising from code you instruct the bot to execute, including but not limited to data loss, security vulnerabilities, unintended side effects, or resource consumption within your workspace.
- You agree not to use Ergod to generate, execute, or distribute malicious code, malware, exploits, or any software intended to cause harm.
AI output disclaimer
Ergod uses large language models to generate responses, code, and actions. AI-generated output is provided "as is" without any warranty of accuracy, completeness, fitness for a particular purpose, or non-infringement. You acknowledge that:
- AI outputs are not guaranteed to be accurate, complete, correct, or free from errors. Models may produce incorrect, misleading, or fabricated information ("hallucinations").
- The bot may generate code that contains bugs, security vulnerabilities, incorrect logic, or outdated practices.
- AI responses do not constitute professional advice of any kind - including but not limited to legal, medical, financial, security, or engineering advice.
- You are solely responsible for evaluating the suitability, accuracy, and safety of any AI-generated output before relying on it, deploying it, or sharing it with others.
- We do not claim ownership of AI-generated outputs. However, you are responsible for ensuring your use of any outputs complies with applicable laws, regulations, and third-party rights.
Your content
You retain all rights to the content you create or upload while using Ergod - your workspace files, pasted code, project materials, and anything else you bring into a session. We do not claim ownership of, and do not license for our own use, any content that originates with you.
The license you grant us is limited and operational: we may store, transmit, and process your content as needed to provide the service (run code in your sandbox, route messages to your selected AI provider for inference, persist files in your isolated workspace, surface relevant context to the agent during your session). This license terminates when you delete the content or your tenant.
Service availability
Ergod is provided "as is" without any guarantees of uptime, availability, or performance. We may experience downtime for maintenance, updates, or unforeseen issues. We do not guarantee that the service will be available at all times or that it will be free of errors.
Subscription & billing
Ergod offers a free tier with daily usage limits and two paid tiers: Pro at $9.99 USD per month and Pro+ at $19.99 USD per month (pricing may adjust during early access; changes will be announced in advance).
- Billing providers: you can subscribe two ways - through Discord's Premium App Subscriptions, or through Stripe on the Ergod website. The price is the same either way; we will never charge more on one than the other. Whichever you pick, that provider - not Ergod - handles payment processing, chargebacks, and receipts, and their billing terms apply to your payments. We never see or store your card details.
- Renewal: subscriptions auto-renew monthly until cancelled. You are billed at the start of each cycle.
- Cancellation: you can cancel at any time - through Discord's subscription settings if you subscribed via Discord, or through the billing portal linked from your Ergod dashboard if you subscribed via Stripe. Cancellation takes effect at the end of the current billing period; you retain paid access until then.
- Refunds: refunds are handled by whichever provider took the payment. For Discord subscriptions, Discord's refund policy governs and we cannot issue refunds directly. For Stripe subscriptions, contact us at ergod.developer@gmail.com.
- One subscription at a time: do not subscribe through both providers. If you do, you will be charged twice and your account will simply use the higher tier. Cancel one and contact us for the duplicate.
- Price changes: we reserve the right to change Pro pricing. Material changes will be announced at least 30 days in advance. You can cancel before the new pricing takes effect.
- Downgrade on non-payment: if Discord or Stripe reports a subscription as cancelled or non-paying, your account reverts to the free tier at the end of the paid period. Workspace data is retained and usable within free-tier limits.
Account termination
We reserve the right to terminate or suspend your access to Ergod at any time if you violate these Terms of Service. This includes, but is not limited to, abuse of the service, attempting to break sandbox isolation, or using the bot for illegal purposes. Termination may result in deletion of your workspace and associated data.
Limitation of liability
To the fullest extent permitted by applicable law, Ergod and its operators, maintainers, contributors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the service. This includes, but is not limited to:
- Loss of data, profits, revenue, or business opportunities
- Damages arising from AI-generated content, code, or recommendations
- Consequences of code execution, whether instructed by you or suggested by the AI
- Service interruptions, errors, or security incidents
- Any reliance on AI-generated output without independent verification
Our total aggregate liability for any and all claims related to the service shall not exceed the greater of (a) the amount you paid to use the service in the twelve (12) months preceding the claim, or (b) ten US dollars ($10).
Indemnification
You agree to indemnify, defend, and hold harmless Ergod and its operators, maintainers, and contributors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the service; (b) your violation of these Terms; (c) your use, deployment, or distribution of any AI-generated output; or (d) code executed at your instruction through the service.
Changes to these terms
We may update these Terms of Service from time to time. When we do, we will update the effective date at the top of this page. Continued use of Ergod after changes are posted constitutes your acceptance of the revised terms.
