Acceptance of Terms
By using the Ergod Discord bot, you agree to these Terms of Service. If you do not agree, please do not use the bot. Continued use of Ergod after any changes to these terms constitutes acceptance of the updated terms.
Service Description
Ergod is an AI agent bot that operates within Discord. It can:
- Read and write files in your isolated workspace
- Execute code and commands within Docker containers
- Search the web and fetch information
- Manage persistent memory and session history
- Coordinate multi-agent tasks
All operations run inside isolated containers scoped to your user workspace.
User Responsibilities
When using Ergod, you agree to:
- Not use the service for illegal activity. Do not use Ergod to generate, store, or distribute illegal content or to assist in any unlawful purpose.
- Not attempt to break sandbox isolation. The containers are isolated for a reason. Do not attempt to escape, exploit, or circumvent container boundaries.
- Not abuse the service. Do not spam, overload, or intentionally disrupt the bot or its infrastructure. Use the service in good faith.
- Respect other users. If you share a server with other Ergod users, do not interfere with their workspaces or sessions.
Code Execution & User Responsibility
Ergod can execute code and commands within isolated Docker containers on your behalf. By instructing Ergod to execute code, run commands, or perform actions, you assume full responsibility for those instructions and their outcomes. Specifically:
- Code runs in sandboxed containers with limited access to the host system. However, you are the decision-maker — the AI acts on your instructions.
- You are responsible for reviewing, understanding, and validating any AI-generated code, commands, or outputs before using them in production, deploying them outside the sandbox, or relying on them for any purpose.
- We are not liable for any consequences arising from code you instruct the bot to execute, including but not limited to data loss, security vulnerabilities, unintended side effects, or resource consumption within your workspace.
- You agree not to use Ergod to generate, execute, or distribute malicious code, malware, exploits, or any software intended to cause harm.
AI-Generated Output Disclaimer
Ergod uses large language models (LLMs) to generate responses, code, and actions. AI-generated output is provided "as is" without any warranty of accuracy, completeness, fitness for a particular purpose, or non-infringement. You acknowledge that:
- AI outputs are not guaranteed to be accurate, complete, correct, or free from errors. Models may produce incorrect, misleading, or fabricated information ("hallucinations").
- The bot may generate code that contains bugs, security vulnerabilities, incorrect logic, or outdated practices.
- AI responses do not constitute professional advice of any kind — including but not limited to legal, medical, financial, security, or engineering advice.
- You are solely responsible for evaluating the suitability, accuracy, and safety of any AI-generated output before relying on it, deploying it, or sharing it with others.
- We do not claim ownership of AI-generated outputs. However, you are responsible for ensuring your use of any outputs complies with applicable laws, regulations, and third-party rights.
Service Availability
Ergod is provided "as is" without any guarantees of uptime, availability, or performance. We may experience downtime for maintenance, updates, or unforeseen issues. We do not guarantee that the service will be available at all times or that it will be free of errors.
Account Termination
We reserve the right to terminate or suspend your access to Ergod at any time if you violate these Terms of Service. This includes, but is not limited to, abuse of the service, attempting to break sandbox isolation, or using the bot for illegal purposes. Termination may result in deletion of your workspace and associated data.
Limitation of Liability
To the fullest extent permitted by applicable law, Ergod and its operators, maintainers, contributors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the service. This includes, but is not limited to:
- Loss of data, profits, revenue, or business opportunities
- Damages arising from AI-generated content, code, or recommendations
- Consequences of code execution, whether instructed by you or suggested by the AI
- Service interruptions, errors, or security incidents
- Any reliance on AI-generated output without independent verification
Our total aggregate liability for any and all claims related to the service shall not exceed the greater of (a) the amount you paid to use the service in the twelve (12) months preceding the claim, or (b) ten US dollars ($10).
Indemnification
You agree to indemnify, defend, and hold harmless Ergod and its operators, maintainers, and contributors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the service; (b) your violation of these Terms; (c) your use, deployment, or distribution of any AI-generated output; or (d) code executed at your instruction through the service.
Changes to These Terms
We may update these Terms of Service from time to time. When we do, we will update the effective date at the top of this page. Continued use of Ergod after changes are posted constitutes your acceptance of the revised terms.
